Agreement to Terms

PLEASE READ THESE TERMS CAREFULLY BEFORE USING THE APP. By downloading, installing, accessing, or using Dream Trip ("the App"), you acknowledge that you have read, understood, and agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not download, install, or use the App.

These Terms constitute a legally binding agreement between you and Dream Trip. You represent that you are at least 18 years old and have the legal capacity to enter into this agreement, or if you are between 13 and 18 years old, that your parent or legal guardian has reviewed and agrees to these Terms on your behalf.

Description of Service

Dream Trip is a travel planning application that provides tools for users to save places, create itineraries, and plan trips. The App includes AI-powered features that generate suggestions and recommendations.

THE APP IS PROVIDED SOLELY AS A PLANNING AND ORGANIZATIONAL TOOL. WE ARE NOT A TRAVEL AGENCY, TOUR OPERATOR, OR BOOKING SERVICE. WE DO NOT SELL TRAVEL SERVICES AND HAVE NO RESPONSIBILITY FOR ANY TRAVEL ARRANGEMENTS, BOOKINGS, OR EXPERIENCES YOU MAY UNDERTAKE. The service is provided "as is" and we reserve the right to modify, suspend, or discontinue any feature or functionality at any time without prior notice or liability.

Assumption of Risk

YOU EXPRESSLY ACKNOWLEDGE AND AGREE THAT YOUR USE OF THE APP AND ANY TRAVEL OR ACTIVITIES UNDERTAKEN BASED ON INFORMATION FROM THE APP IS AT YOUR SOLE RISK. Travel inherently involves risks including but not limited to:

• Physical injury, illness, or death
• Property damage, loss, or theft
• Financial losses from trip cancellations, delays, or changes
• Natural disasters, political instability, or civil unrest
• Inaccurate or outdated information about destinations, businesses, or conditions
• Changes to business hours, closures, prices, or availability
• Safety hazards at any recommended location

You assume full responsibility for all such risks and agree that Dream Trip shall have no liability whatsoever for any travel-related incidents, injuries, losses, or damages of any kind.

User Accounts

Dream Trip requires an account, created with Sign in with Apple or Sign in with Google. By using the App, you agree to:

• Accept full responsibility for all activities occurring under your account or from your device
• Provide accurate information if you choose to add a display name or profile
• Understand and accept that account data may be permanently lost if you uninstall the App, reset your device, or clear app data, and that we have no obligation to recover such data
• Maintain the security of your device and account access

Subscriptions and Payments

Dream Trip offers both free and premium subscription tiers.

Free Tier

The free tier includes limited access to features. Specific limits are displayed within the App and may change at our sole discretion without notice.

Dream Trip Pro

Premium subscriptions unlock additional features. Available subscription options:

• Weekly: $4.99 USD per week
• Yearly: $89.99 USD per year (includes a 3-day free trial)

Prices are in US dollars and may vary by region. Current pricing is always displayed in the App before purchase. We reserve the right to change pricing at any time.

Free Trial

New subscribers may be eligible for a free trial period. If you do not cancel before the trial ends, your subscription will automatically convert to a paid subscription and you will be charged. Any unused portion of a free trial period will be forfeited when you purchase a subscription.

Billing and Renewal

• Payment will be charged to your Apple ID account at confirmation of purchase
• Subscriptions automatically renew unless canceled at least 24 hours before the end of the current period
• Your account will be charged for renewal within 24 hours prior to the end of the current period
• You can manage and cancel your subscriptions by going to your device's account settings after purchase

Refunds

All purchases are processed through the Apple App Store. We do not process payments directly and cannot issue refunds under any circumstances. For refund requests, contact Apple directly. We make no guarantees regarding Apple's refund decisions.

No Professional Advice

THE APP DOES NOT PROVIDE PROFESSIONAL TRAVEL, LEGAL, MEDICAL, FINANCIAL, OR SAFETY ADVICE. All information, recommendations, and AI-generated content are for general informational purposes only and should not be relied upon as professional advice. You should consult appropriate professionals and official sources (government travel advisories, local authorities, medical professionals, etc.) before making any travel decisions. We expressly disclaim any responsibility for decisions you make based on App content.

Acceptable Use

You agree not to use the App to:

• Violate any applicable law, regulation, or third-party rights
• Upload or transmit any harmful, illegal, or objectionable content
• Attempt to gain unauthorized access to any systems or accounts
• Interfere with or disrupt the App or its infrastructure
• Engage in any automated use of the system without permission
• Use the App for any commercial purpose without written consent

Violation of these terms may result in immediate termination of your access without notice or refund.

User Content

You retain ownership of content you create. By posting content through the App, you grant us a perpetual, non-exclusive, worldwide, royalty-free, sublicensable, transferable license to use, reproduce, modify, adapt, publish, translate, distribute, and display your content in connection with operating the service.

You represent and warrant that you have all necessary rights to grant this license and that your content does not violate any laws or third-party rights. You are solely responsible for your content and any consequences of posting it.

We reserve the right to remove any content at our sole discretion, without notice or explanation. We have no obligation to store, maintain, or provide copies of your content.

AI-Generated Content Disclaimer

THE APP USES ARTIFICIAL INTELLIGENCE TO GENERATE CONTENT. YOU ACKNOWLEDGE AND AGREE THAT:

• AI-generated content is experimental and provided for informational and entertainment purposes only
• AI output may be inaccurate, incomplete, misleading, biased, or entirely fabricated ("hallucinations")
• AI suggestions may be outdated and may not reflect current conditions, prices, availability, safety conditions, or regulations
• YOU MUST INDEPENDENTLY VERIFY ALL INFORMATION before making any travel plans or decisions
• We make NO WARRANTIES whatsoever regarding AI-generated content
• WE EXPRESSLY DISCLAIM ALL LIABILITY for any actions taken or not taken based on AI-generated content
• Reliance on AI-generated content is entirely at your own risk

By using AI features, you acknowledge these limitations and agree to hold Dream Trip harmless from any claims arising from AI-generated content.

Third-Party Content and Services

The App may display, link to, or process content from third-party sources. YOU ACKNOWLEDGE THAT:

• We do not own, control, verify, endorse, or assume any responsibility for third-party content
• Third-party content may be inaccurate, outdated, incomplete, or misleading
• We are not responsible for the availability, accuracy, legality, or quality of third-party content or services
• Your interactions with third parties are solely between you and them
• Any losses or damages incurred from third-party interactions are your sole responsibility

Intellectual Property

The App and all its contents, features, and functionality are owned by Dream Trip and protected by intellectual property laws. You receive only a limited, non-exclusive, non-transferable, revocable license to use the App for personal, non-commercial purposes. You may not copy, modify, distribute, sell, lease, reverse engineer, or create derivative works without our prior written consent.

DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW:

THE APP, ALL CONTENT, FEATURES, SERVICES, AND AI-GENERATED OUTPUT ARE PROVIDED "AS IS," "AS AVAILABLE," AND "WITH ALL FAULTS" WITHOUT ANY WARRANTIES OR CONDITIONS OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

WE EXPRESSLY DISCLAIM ALL WARRANTIES, INCLUDING BUT NOT LIMITED TO: IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, RELIABILITY, AVAILABILITY, TIMELINESS, SECURITY, AND ANY WARRANTIES ARISING FROM COURSE OF DEALING OR USAGE OF TRADE.

WE DO NOT WARRANT THAT: (A) THE APP WILL MEET YOUR REQUIREMENTS; (B) THE APP WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR-FREE; (C) THE RESULTS OBTAINED FROM THE APP WILL BE ACCURATE, RELIABLE, OR CURRENT; (D) ANY ERRORS WILL BE CORRECTED; (E) THE APP WILL BE FREE OF VIRUSES OR HARMFUL COMPONENTS.

NO ADVICE OR INFORMATION OBTAINED FROM US OR THROUGH THE APP SHALL CREATE ANY WARRANTY NOT EXPRESSLY STATED IN THESE TERMS.

LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL DREAM TRIP, ITS OWNERS, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, AFFILIATES, LICENSORS, OR SERVICE PROVIDERS BE LIABLE FOR ANY:

• INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES
• LOSS OF PROFITS, REVENUE, BUSINESS, SAVINGS, GOODWILL, OR DATA
• PERSONAL INJURY OR PROPERTY DAMAGE OF ANY NATURE
• INTERRUPTION OF BUSINESS
• COST OF SUBSTITUTE GOODS OR SERVICES
• ANY DAMAGES ARISING FROM: (I) YOUR USE OR INABILITY TO USE THE APP; (II) ANY TRAVEL OR ACTIVITIES UNDERTAKEN BASED ON APP CONTENT; (III) ANY THIRD-PARTY CONDUCT OR CONTENT; (IV) UNAUTHORIZED ACCESS TO YOUR DATA; (V) AI-GENERATED CONTENT; (VI) ANY OTHER MATTER RELATING TO THE APP

THIS APPLIES REGARDLESS OF THE THEORY OF LIABILITY (CONTRACT, TORT, NEGLIGENCE, STRICT LIABILITY, OR OTHERWISE) AND EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE EXTENT THE FOREGOING LIMITATION IS NOT PERMITTED BY LAW, OUR TOTAL CUMULATIVE LIABILITY TO YOU FOR ALL CLAIMS ARISING FROM OR RELATED TO THE APP SHALL NOT EXCEED THE GREATER OF: (A) THE AMOUNTS YOU PAID TO US IN THE SIX (6) MONTHS PRECEDING THE CLAIM; OR (B) FIFTY US DOLLARS ($50.00).

THE LIMITATIONS IN THIS SECTION APPLY TO THE FULLEST EXTENT PERMITTED BY LAW IN THE APPLICABLE JURISDICTION. SOME JURISDICTIONS DO NOT ALLOW CERTAIN LIMITATIONS, SO SOME OF THESE LIMITATIONS MAY NOT APPLY TO YOU.

Indemnification

YOU AGREE TO INDEMNIFY, DEFEND, AND HOLD HARMLESS Dream Trip and its owners, officers, directors, employees, agents, affiliates, licensors, and service providers from and against any and all claims, demands, damages, losses, liabilities, costs, and expenses (including reasonable attorneys' fees and court costs) arising out of or related to:

• Your use of or access to the App
• Your violation of these Terms
• Your violation of any law or rights of any third party
• Your content or any content you submit through the App
• Any travel or activities you undertake based on App content
• Any claim by a third party related to your use of the App
• Your negligence or willful misconduct

We reserve the right to assume exclusive defense and control of any matter subject to indemnification by you, at your expense. You agree to cooperate fully with our defense of any such claims.

Force Majeure

We shall not be liable for any failure or delay in performance due to circumstances beyond our reasonable control, including but not limited to: acts of God, natural disasters, pandemics, epidemics, war, terrorism, riots, civil unrest, government actions, embargoes, labor disputes, power failures, internet or telecommunications failures, hardware or software failures, cyberattacks, or any other event beyond our control.

Termination

We may terminate or suspend your access to the App immediately, without prior notice, warning, or liability, for any reason or no reason, including but not limited to breach of these Terms. Upon termination:

• Your right to use the App immediately ceases
• We may delete your account and all associated data without notice
• You will not be entitled to any refund of subscription fees
• All provisions that should survive termination shall survive (including disclaimers, limitations of liability, indemnification, and dispute resolution)

Dispute Resolution and Arbitration

PLEASE READ THIS SECTION CAREFULLY. IT AFFECTS YOUR LEGAL RIGHTS, INCLUDING YOUR RIGHT TO FILE A LAWSUIT IN COURT.

Binding Arbitration: Any dispute, claim, or controversy arising out of or relating to these Terms or the App shall be resolved exclusively through final and binding arbitration, rather than in court. The arbitration shall be conducted on an individual basis and not as a class, consolidated, or representative action.

Class Action Waiver: YOU AGREE TO WAIVE ANY RIGHT TO PARTICIPATE IN A CLASS ACTION LAWSUIT OR CLASS-WIDE ARBITRATION. You may only bring claims against us on an individual basis and not as a plaintiff or class member in any class or representative proceeding.

Jury Trial Waiver: YOU HEREBY WAIVE ANY RIGHT TO A JURY TRIAL in connection with any dispute arising under these Terms.

Exceptions: Either party may seek injunctive relief in any court of competent jurisdiction for violations of intellectual property rights or confidentiality obligations.

Governing Law

These Terms shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. To the extent court proceedings are permitted, you consent to exclusive jurisdiction in courts located in the applicable jurisdiction.

Changes to Terms

We reserve the right to modify these Terms at any time at our sole discretion without individual notice. Changes become effective immediately upon posting. Your continued use of the App after changes constitutes acceptance of the modified Terms. It is your responsibility to review these Terms periodically.

Severability

If any provision of these Terms is held to be invalid, illegal, or unenforceable, that provision shall be modified to the minimum extent necessary to make it valid and enforceable, or if modification is not possible, shall be severed from these Terms. The remaining provisions shall continue in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms shall not constitute a waiver of that right or provision. Any waiver must be in writing and signed by us to be effective.

Entire Agreement

These Terms, together with our Privacy Policy and any other legal notices published by us, constitute the entire agreement between you and Dream Trip regarding your use of the App. These Terms supersede all prior agreements, representations, and understandings.

Assignment

You may not assign or transfer these Terms or your rights hereunder without our prior written consent. We may assign these Terms without restriction. Subject to the foregoing, these Terms shall bind and inure to the benefit of the parties and their permitted successors and assigns.
